Terms and Conditions

The terms 'we', 'our' and 'us' means Maximise Enterprises Ltd. 'You' and 'group contact' refers to the person who has made the reservation and each member of the group on whose behalf the group contact has booked.

It is important that you read these terms and conditions. Your contract is with Maximise and these terms and conditions apply to all bookings taken from 1 January 2012 whether you have read them or not and they apply to all members of the group on whose behalf the group contact has booked.

We understand and accept that every group leader understands and accepts our terms and conditions at point of booking whether the booking is made over the telephone, in person, in writing or via the Internet. It is the group leader's responsibility to ensure every member of his/her party is aware of and adheres to our terms and conditions and supplies all information to the group accurately. Our terms and conditions are available and easily accessible via our website and in our brochures. We also make them available to you via a link on the confirmation of booking. By paying your deposit you acknowledge that you agree to our terms.

To secure a booking we require a non-refundable deposit as notified at the time of booking. Once the deposit has been paid a booking confirmation will be set to you via email. Only on receipt of your Booking confirmation is the booking confirmed. The group leader is responsible for full payment regarding any weekend or events booked. If there is a change in the group leader, we must be notified in writing. 

We try to be as flexible as possible with groups and do allow individuals who cannot make the full weekend to attend the elements they can, however we will only permit 4  variations to the main package. Once five variations have been reached (including the main package), attendees must fit in to one of these packages.

What Happens if you want to cancel?

Once your booking has been confirmed, a cancellation will only be accepted in writing from the group contact.

Cancellation Charges will apply at the date we receive written notification of cancellation of the whole booking. You will not be able to cancel part of your booking.
More than 42 days before date of departure (DOD) - Loss of deposit redeemable only against a future event booked with Maximise within 3 months of cancellation, and of similar value (up to a maximum 20% less than the cost of your weekend)
42 - 21 days before DOD - 50% of Total Package Cost
20 Days or Less Before DOD - 100% of Total Package Cost.

You will also be liable for 100% of the cost of any pre paid tickets, insurance premiums, flights, transfers, vouchers, overseas accommodation and activity deposits that we have booked or purchased on your behalf. Pre paid tickets, insurance premiums, flights, transfers and vouchers are non refundable and the group leader will supply a credit card as a bond against failure, where applicable, to pay for package elements booked and arranged on your request. Monies will only be taken in the event the group fail to pay.

All flight tickets are non refundable. Depending on the reason for cancellation some of these charges may be recoverable under your insurance policy - please refer to your policy for further information. Name changes are subject to individual airline policies and charged accordingly.

Bookings made within four weeks of the date of departure will be paid in full at the point of booking and will be subject to cancellation charges as above.

If you wish to cancel on behalf of only some of the group then the cancellation charges outlined above will apply pro rata but we may become entitled to cancel the event if numbers drop significantly. Your deposit in this instance remains non refundable. All cancellations must be sent to us in writing. We strongly recommend that clients insure against cancellation. Refunds for individual cancellations will be subject to a £20 administration charge per transaction.

If you do wish to cancel under normal conditions before you are due to pay your balance (42 days before DOD) then Maximise agrees to honour your deposit against any future event booked with us, providing that the value of that future event is not less than 20% of the value of your weekend.

No refunds will be made if you or any group members choose to leave your arrangements early or choose, for whatever reason, not to participate in any of the events on your itinerary.

What Happens If You Want To Make A Change?

You may not change your reservation to a special offer that may subsequently become available. You cannot transfer insurance premiums from one person to another.

We may be able to add additional persons onto your party after you have made your booking but this is always subject to availability. Your party size can be increased or decreased without charge up until your Final Payment Date, four weeks prior to your event and shown on your written confirmation. However, if you wish to add on additional persons after this date this will be subject to a £20 per person charge.

We will endeavour to accommodate any group that wishes to change their booking date, timings of an event, location and/or activity changes. However this is always subject to availability and carries a £20 administration charge per change.

If any member of your part is prevented from participating or travelling because of the death, injury or serious illness of that person, close relative or friend or jury service we will not refund but we will allow transfer of the booking to another person. We will not charge our £20 administration charge to change this name, however any costs imposed by our suppliers will be passed on. Maximise will charge for name changes, with charges being dependent on the Airline supplier. Some airlines may impose a 100% cancellation charge and the cost of a new ticket, plus administration charges, which you will be responsible for paying.

As your contract is with Maximise, all changes and requests must be made directly with us and not our suppliers.

What If We Cancel?

In most cases neither you nor we are entitled to cancel because of adverse weather conditions. Maximise are not obliged to offer refunds for events affected by or cancelled due to adverse weather conditions.

For some events if the safety risks are, in our opinion, unacceptable we reserve the right to cancel the event. If we do cancel in such circumstances we will offer an alternative comparable activity or make every effort to reschedule the event for another date. If we cancel an event for anything that falls within our control we will provide you with a credit to rearrange the cancelled activity. This credit will be valid for six months. This will also apply to any rescheduled event.

Late Bookings

We consider a late booking to be a booking made within 4 weeks of a departure date. Any bookings made within this period are not subject to our standard payment terms. Payment in full is required upon booking. You are not obliged to cancel a late booking at any time. All late bookings are subject to availability and it is understood that you have read our terms and conditions.

What Happens If We Make a Change?

Maximise always aim to operate all the tours and arrangements as advertised and booked. By entering into a booking with Maximise and accepting our terms and conditions the client accepts that it may prove necessary or advisable to vary or modify an itinerary or its contents due to prevailing local conditions.

Maximise reserves the right at any time to cancel or change any of the facilities, services or prices, including and not limited to flights, accommodation, activities, restaurants, entertainment venues, tickets, transfers and to substitute alternative arrangements of comparable monetary value without compensation and accepts no liability for loss of enjoyment as a result of these changes. Given the time of booking is often months in advance of the date of travel, Maximise reserves the right to change or alter menus or drink offerings within its packages without any notice subject to changes in menu or bars. 

We will always endeavour to notify you of any changes as soon as possible. However, under no circumstance are we obliged to cancel or refund any element of a weekend cancelled due to war and, threat of war, riots, terrorist activity, industrial disputes, natural disasters, fire, airport closures (delayed flights), bad weather conditions and similar events beyond our control.

All accommodation that we use is advertised and booked in twin rooms, unless otherwise stated. However, subject to changes in numbers and most suitable configurations, we reserve the right to move members of the same sex to different room configurations to make the best use of available accommodation.

If an event within a package, which we organise, becomes unavailable we will have the choice of organising an alternative activity (in consultation with you), or making a proportional refund.

You will not be entitled to cancel the booking. If we decide that the event is a subsidiary and not a principal part of any package, we will not be obliged and you will not be entitled to cancel your booking.

Wherever possible we will always try and accommodate reduction in numbers incurring no cost to the group. However should the numbers attending be insufficient to run all or part of the event we reserve the right to charge the group for the minimum numbers required for the event.

Please note that an uneven number of participants in your group may attract a hotel single supplement surcharge. If triple rooms are available at the accommodation we will endeavour to book one for your group. However if a single room has to be booked the group will be liable to pay the supplement as prices are based on shared occupancy.

Prices and Price Changes

By booking with us you agree to pay the prices quoted to you at the time of booking. These prices will not increase so long as there have been no changes to your booking and they havent dropped subject to minimum numbers, with the exception of circumstances in which there are variations in the following costs which we will pass on to you - transport costs, including costs of fuel or major fluctuation in exchange rates. Prices displayed in brochures, communications and websites are available but may be subject to limited availability, date restrictions or conditions and qualification. We will only increase the price if our costs increase as a result of any adverse changes in any of the exchange rates which have been used to calculate the cost of your holiday. Packaged prices are based on the following exchange rates; 1GBP = 1.15 Euro. A 10% fluctuation from point of booking represents an adverse change. If this means paying more than 10% on the holiday price, you will be entitled to cancel your holiday with a full refund of all money paid to us except for insurance premiums and amendment charges. This must be done within 14 days of the date printed on your surcharge invoice. Surcharges will not be levied within 28 days of your departure.

Payment and Surcharges

We accept the following methods of payment: Debit Card, all major Credit Cards (excluding American Express, Transax and Diners) and payment directly into our bank account via BACS or online transfer.

Payment by cheque, cash or direct transfer payment does not carry a surcharge. Payment by debit card is subject to a 1% surcharge, a Credit card is subject to a 2.5% surcharge, which represents the charge we incur for processing such payments. Uncleared cheques or cheques that are referred to drawer are subject to a £25 handling charge per occurrence.

If any members of your group choose to pay by calling the Maximise admin team, bypassing the online payment facility, an admin fee of £5 will be added to your payment. Payments made online using our MyWeekend Online facility do not incur this fee. We do not accept cheques.

All groups must pay a deposit to secure their booking. Your final balance is due 43 days before your weekend date but the exact date is always stated on your confirmation. If you do not pay us within the time limits specified you may jeopardise our ability to provide the event and we have the right to treat all or part of the booking as cancelled and you will be liable for the cancellation charges due to us under this agreement.

Once you have placed a booking and we have confirmed your details in writing the details will not usually change, providing the arrangements and group size remain the same. Surcharges will apply where minimum numbers are not reached for an activity or event to proceed or room configurations incur single room supplements. In the event that an activity cannot take place due to a fall in numbers we reserve the right to cancel your event and refund all monies paid for that event, or offer alternative arrangements.

Money

Monies paid to us are held in a separate account until after you have participated with your arrangements or until the services that provide your arrangements have been paid in advance.

Behaviour

Upon booking a Maximise weekend it is understood that you agree to behave in a safe and courteous manner at all times. You also agree to obey the proper instructions of any activity leader, and will dress and equip yourself suitably for any event. You also agree to use safety equipment as instructed and not tamper with or abuse it. You also agree to compensate our contractors or us for any damage or loss of revenue caused by you in the course of an event.

We understand the fact you have booked a fun weekend. However, as a Maximise customer you are expected to behave in a safe and courteous manner at all times. You must ensure you arrive on time for all events, obey all instructions given to you by activity leaders and dress appropriately for your activities. You are not permitted to arrive at any accommodation or activity suppliers under the influence of alcohol or drugs under any circumstances. Maximise will not be liable for any refusal of entry or participation in an activity if your group fails to conduct yourselves as detailed in this clause.

Certain suppliers insist on a behavioural bond to be deposited by the group on arrival. Management may refuse your group entry or access to activities without this bond and Maximise will not be liable for your arrangements if this clause is not adhered to, or if the management refuse entry. No refund will be due if you do not provide a bond for your group. 

Accommodation

If your group booking includes accommodation the name and address of the accommodation will only be disclosed to you on receipt of your final balance. The location of the accommodation we booked is deemed centrally located at our discretion. Our accommodation will provide good access to all elements of your weekend package to include nightlife and daytime activities. 

Maximise grade hotels based on a number of factors including facilities, location, feedback and Maximise Stag and Hen group suitability. Therefore, the grade that Maximise assign to a hotel may differ from other hotel grading systems and other companies, both official and unofficial. Maximise reserve the right to accommodate groups in separate hotels where facilities are shared. Basic B&B and Surf Style accommodation can, on rare occasions, be without en suite facilities. 

Hotels will require the group to leave a behavioural bond/deposit on checking in. These are preventative measures to protect the hotel from damage and complaints from other guests and against bad behaviour. Security deposits are common place for large group bookings and failure to pay will result in the group not being allowed to stay. If you refuse to pay the bond, your accommodation will not be made available to you and no refund will be due.


Meals and Special Requirements

Many of our restaurant providers require pre ordering before you arrive at the venue. It is your responsibility to complete the pre order and return it by the date specified. Failure to do so may result in your menu being selected for you. We will always endeavour to accommodate party members with special dietary requirements but cannot guarantee an alternative will be arranged. All special requirements must be communicated to Maximise and our suppliers as soon as possible. Our suppliers reserve the right to change or alter any set menus without notice. Maximise are not liable for any food allergies.

You must make our suppliers and us aware of any medical circumstances that may affect your safety or health whilst participating in any activities.

Event Timings and Itineraries

We assemble each itinerary with the greatest of care using our wealth of experience in the industry. As stated in our itineraries all groups are required to arrive at their activity sites 30 minutes prior to their start time to allow for a smooth running programme. Failure to do so may result in the quality and duration of your activity being compromised. Maximise will not be liable in the event of your group failing to arrive at an activity or venue at the time specified.

Maximise will always attempt to meet the specific requests for start times for any activity however due to the volume of bookings we consider an hour either side of any request to be reasonable. Any start time more than an hour either side of any request will be advised before confirming your booking. where more than one event has been booked one a single day we reserve the right to switch activities to allow us to meet the requirements of the group.

Participation in activities that are not booked as part of your itinerary with Maximise or have been booked independently of the reservation will not be the responsibility of Maximise and we shall not be liable.

Maximise packages in the UK do not include transfers as full maps and directions are provided to all groups. Maximise can provide quotes for transfers to activities within a Maximise UK destination if requested.

Most daytime activities take place at outdoor activity centres, which by their nature are not usually located in city centres/urban areas. Activities advertised by us as taking place in a particular city/town may include activities in locations that we consider to be within a reasonable distance from your accommodation and or the city/town. As a general guide we consider a reasonable distance to be approx. 30 miles or 40 minutes drive time although this may be more for some exclusive or specialist activities and those that use naturally occurring facilities such as rivers, sea or hills.

Maximise event itineraries are final. It is the group leader's responsibility to check all details and timings prior to departure. Once issued, it is your responsibility to read fully the contents of the documents and notify us immediately if you have any queries. We cannot accept liability for any omissions or errors if we have not been notified within 7 days of making the documents available to you. Maximise will correct any errors or omissions prior to travel and provide a revised travel itinerary showing amended information. If we have not been notified we cannot accept any responsibility for errors or omissions.

Flights, Passports, Visas and Vaccinations

Group members are responsible for ensuring that they hold the correct documentation, are in possession of a valid passport with suitable time until expire to enter the chosen country, visa permits, inoculations and preventative medicines as may be required.

Passenger names provided for flight bookings must be provided by email in full as they appear on their passport. Failure to provide names correctly may mean you are refused permission to board the plane. Please do not use nicknames. It is the responsibility of the group contact to verify the names booked, prior to departure. Flight prices are quoted for hand luggage unless otherwise specified or requested. Changes to flight bookings relating to passenger details or changes to passengers names will be charged at the airlines rates.

We accept no responsibility or liability if any group members are refused boarding a flight for any reason.

Maximise flight itineraries are final. It is the group leader's responsibility to check all details and timings prior to departure. Once issued, it is your responsibility to read fully the contents of the documents and notify us immediately if you have any queries. We cannot accept liability for any omissions or errors if we have not been notified within 7 days of making the documents available to you. Maximise will correct any errors or ommissions prior to travel and provide a revised travel itinerary showing amended information. If we have not been notified we cannot accept any responsibility for errors or omissions.

Beauty Treatments

If you or members of your party are required to choose a treatment from a selection that Maximise has provided, these choices must be made and forwarded to Maximise by your Final Payment Date. Failure to do so may result in your treatments being chosen for you or options not being available. All special requirements must be communicated to Maximise and our suppliers as soon as possible. We will endeavour to accommodate all persons with special requirements but cannot guarantee a suitable alternative will be arranged. Our suppliers reserve the right to change or alter treatments without notice.

How Do We Deal With Risk?

We organise a wide range of events and some of them involve a degree of risk you of physical injury of damage to property. This is what makes these events exciting! We do not exclude our liability for death of personal injury caused by our negligence or that of our employees, but we do not accept liability for the negligence of any other persons. We do all that we reasonably can to reduce the risk to you. If we have done that and are not negligent, you will take responsibility for any risks involved in participation in any event. We cannot accept liability in any unusual or unexpected circumstances beyond our control, which we could not have avoided even if we had used all care possible, or any event which we or our supplier could not help, expect or prevent.

Advertising and Special Offers

All photographic and pictorial references found in our brochure and on our website are purely representative of the products & events we offer and will be accepted as such.

All accommodation packaged and advertised by Maximise is done so using our own opinions and interpretations of that Hotel's star rating, location and facilities. Our grading and interpretations may sometimes differ to that which the hotel and/or other companies, both official and unofficial, advertise.

Price promise guarantees are valid for up to 5 working days after the point of booking and do not include any special offers or limited promotions offered by any competitors. All Maximise special offers are subject to compliance with our payment terms and conditions, and any other restrictions or requirements that we have put in place for the offer.

Insurance

It is essential that you arrange adequate insurance to accommodate your party and their requirements. If you do not take out insurance through Maximise we will assume you have arranged your own cover via another provider. It is important that you ensure that any insurance policy covers personal accident, medical and emergency evacuation, loss of monies and participation in your chosen activity or dangerous sport.

If you decide not to take out travel insurance suitable for your arrangements independently, you hereby agree to indemnify us against any claim or loss or injury, and you and your group members participate entirely at your own risk.

Certain activity providers may insist you sign an insurance indemnity and waiver form; therefore you participate at your own risk, and we shall not be liable for your participation.

Complaints

Although the quality of our arrangements is high, sometimes things may go wrong. If a complaint or problem arises during your weekend you must telephone a Maximise Representative on the emergency contact number supplied immediately. Our reps are there to help, so if you fail to call and report any such problems or issues to allow us to put the these right, we will not consider ourselves to be liable for those complaints. If you have a complaint regarding any element of your booking you must notify us in writing. Complaints must be forwarded in writing to us within 7 days after your event. We will acknowledge receipt of your correspondence and we will respond to all complaints in written format within 28 days. The group contact must bring all complaints to our attention.

General

We believe our Terms and Conditions to be fair. The law of England and Wales governs them. We reserve the right to make amendments and improvements to these terms and conditions without notice. For the full and latest version of our terms and conditions please visit our website.
